Student Concern, Complaint, and Grievance Procedures
Scope and Purpose
The purpose of these procedures is to provide currently enrolled Huntingdon College students with an opportunity to resolve complaints alleging improper, unfair or arbitrary treatment.
TITLE IX / SEXUAL MISCONDUCT AND DISCRIMINATION: These procedures do not pertain to incidents that fall under the scope of the Huntingdon College Sexual Misconduct & Discrimination Policy.
GRADE APPEALS: These procedures do not pertain to academic grade appeals. The Grade Appeal Policy and procedures can be found under the Academic Policies section of the Huntingdon College website.
Definitions:
- Concern: A concern is something that relates to, is of importance or interest to or affects a student. If you have a concern, it is an informal method of communicating something to the college. If you have a concern, you simply want someone to know about it, but do not necessarily want someone to follow up with you. No meeting will necessarily be scheduled, but the Student Development Office may follow up with you.
- Complaint: A complaint is a written claim by a student alleging improper, unfair or arbitrary treatment. Each student who has a complaint must make every effort to resolve the matter on an informal basis prior to pursuing a formal grievance. The Student Complaint Resolution Officer acts as a mediator between all parties for the informal complaint mediation process. Attempts to resolve the informal mediation process should be completed within thirty (30) days from the time at which the student knew or could have reasonably be expected to have known of the action being grieved. Below are the steps that will normally be followed as a part of the complaint resolution process.
Academic or Course Related Complaints
- Meet with instructor.
- Meet with the appropriate department chair.
- Meet with the appropriate Associate Dean.
- Meet with Dean for Faculty.
Athletic Complaints
- Meet with Coach.
- Meet with Athletic Director
All other complaints
- Meet with Director of Student Engagement.
- Meet with Dean of Students.
- Grievance: A grievance is a written claim raised by a student, alleging improper, unfair or arbitrary action by an employee involving the application of a specific provision of a College rule/regulation or procedure.
Grievance Procedures:
If a student is not satisfied with the outcome of the informal mediation process, the student may file a formal student grievance within twenty (20) business days from the time of the completion of the informal complaint resolution process.
Student grievances must be in writing and signed by the student. Unsigned submissions will not be accepted. Grievances must contain the student’s address and phone number, a detailed statement of the specific action being grieved, the approximate date when the action took place, the resulting injury or harm, the specific policy or rule alleged to have been violated, a description of the evidence supporting the grievance, and the remedy or relief requested.
The student complainant may be assisted by the Student Complaint Resolution Officer during the grievance process.
Upon receipt of a formal student grievance, the Student Grievance Resolution Officer shall review the grievance and make an initial determination regarding whether the grievance is complete, timely, within the jurisdiction of the Student Grievance Procedure, and alleges facts which, if true, would constitute a violation of College policy. The GRO shall complete an initial review of the grievance and notify the complainant of the determination in writing within twenty (20) days of the receipt of the formal grievance.
If the GRO determines that the grievance is incomplete, the student will have ten (10) business days from the date of the written notice to make the grievance complete. If the student fails to make the grievance complete, the grievance will be dismissed. If the GRO determines that the grievance is untimely, outside the jurisdiction of the policy, or factually insufficient, the grievance will be dismissed.
If a complaint is dismissed, the GRO will provide the student with a written explanation of the basis for the dismissal. The student will have ten (10) business days from the date of the written notice of dismissal to request an appeal of the dismissal from the Executive Vice President of the College. The request for appeal must be a signed, written document articulating why the decision by the GRO to dismiss the case was in error. The Executive Vice President of the College will respond in writing within twenty (20) business days of receipt of the appeal. If the decision to dismiss is upheld, that decision is final. If the decision to dismiss is overturned on appeal, the case shall be sent back to the GRO for investigation in accordance with the procedures outlined below.
If the GRO determines that a complaint is complete, timely, and has potential merit, copies of the complaint, along with any relevant documentation will be provided to the members of the Student Grievance Committee and will arrange for the date and time for an interview. Interviews will be scheduled no later than twenty (20) business days following the submission of the complaint. The refusal of any party to attend the scheduled interview date shall not result in a delay in the proceeding.
The Committee shall interview all parties and review any and all evidence presented. Subsequent to the interview process, the Committee will deliberate in executive session and reach a determination. A majority of the three Committee members must agree on a finding for or against the complainant.
The Committee will present its findings in writing to the GRO within ten (10) business days of the conclusion of the interview process. The GRO will review the suggested remedy(s) and/or sanction(s), and inform the complainant in writing.
Decisions, remedies and/or sanctions may be appealed by the complainant to the Executive Vice President of the College within ten (10) business days of receipt of the written notification of final outcome from the GRO. The request for appeal must be a signed, written document articulating why the decision of the Committee was in error, or why the remedies and/or sanctions levied were not appropriate.
The Executive Vice President will respond in writing within twenty (20) business days of receipt of the written appeal. All decisions of the Executive Vice President are final.
